Trust Litigation

Trusts are frequently created in wills, defining how money and property will be handled for children or other beneficiaries. The trustee is given legal title to the trust property, but has a fiduciary duty to act in the best interests of the beneficiaries. These fiduciary duties generally include a duty to invest the assets in a prudent manner, a duty of loyalty and  a duty to refrain from self-dealing, as well as other duties.  By their nature, these  claims can be very contentious and need to be pursued by counsel well versed in fiduciary law.
